An emergency does not remove legal requirements
Even in an urgent situation, the signer must be present for the required act, communicate willingness, and be properly identified. The document must be complete enough to notarize, and the requested notarial act must be permitted. A notary cannot backdate a certificate, notarize for an absent person, ignore signs of coercion, or proceed when the signer cannot participate knowingly and willingly.
If a signer is in a hospital or care facility, confirm that the person is awake and available before booking. Medication, medical procedures, visiting restrictions, and witness availability can affect the appointment.
